These Terms and Conditions (“Terms”) govern your access to and use of the Boldly Becoming mobile application (“App”), owned and operated by Heather Heselton (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you should not use the App.
The App is designed to support your personal growth and development by providing coaching content, journaling features, prompts, and tools rooted in self-mastery principles. All content provided through the App is for educational and informational purposes only and is not intended as medical, psychological, legal, or financial advice.
To use the App, you must be at least 13 years of age. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian before proceeding.
You agree to use the App in a lawful, respectful, and ethical manner. You must not misuse, hack, interfere with, or disrupt the App’s functionality, or use the App to harm, harass, or violate the rights of others. You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account.
All content, branding, and intellectual property within the App—including text, graphics, prompts, modules, videos, and audio—is owned by or licensed to us and is protected by copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only. You may not copy, modify, distribute, or exploit any part of the App without our express written permission.
We reserve the right to modify or discontinue any part of the App at any time, with or without notice. We may also change these Terms from time to time. Any updates will be posted within the App or on our website. Your continued use of the App after changes are made constitutes your acceptance of the updated Terms.
The App is provided on an “as-is” and “as-available” basis. We make no warranties or guarantees regarding the accuracy, completeness, availability, or suitability of the content or services. To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, or consequential damages that may result from your use of the App.
You agree to indemnify and hold harmless Heather Heselton and all affiliated personnel or partners from any claims, damages, liabilities, or expenses arising from your use of the App, your violation of these Terms, or your infringement of any intellectual property or other rights.
If you breach these Terms or we suspect misuse of the App, we reserve the right to terminate or restrict your access to the App at our sole discretion, without notice or liability.
These Terms are governed by the laws of the state of California, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms shall be brought in the courts located in California, and you consent to the jurisdiction of such courts.
If any part of these Terms is deemed invalid or unenforceable, the remainder will remain in full force and effect.
